This Privacy Notice details information regarding the use and disclosure of User information collected through the ICS Mobile, INC Services. This Privacy Notice is incorporated into and is subject to the ICS Mobile, INC Terms of Use. Your use of the ICS Mobile, INC Services and any personal information you provide on the ICS Mobile, INC Services remains subject to the terms of this Privacy Notice and the Terms of Use.

IMPORTANT DISCLOSURES AND CONSENTS:

Data plans are required to use the ICS Mobile, INC Services. ICS Mobile, INC requires the use of standard data and taxes from your carrier apply.
To provide ICS Mobile, INC, we collect, maintain, use, and display your personal data and the geographic location of your mobile device (
ICS Mobile, INC shows your phone's current geo-location to your selected "ICS Mobile, INC "iTag session players" .
In order to subscribe to the ICS Mobile, INC Services, you must consent to: (a) the use of your phone's location to provide ICS Mobile, INC to you, including the display & disclosure of that location information to your ICS Mobile, INC "iTag session players" and within your geo-tagged messages & content, (b) pay carrier data & other fees resulting from ICS Mobile, INC usage.

THE INFORMATION ICS MOBILE, INC COLLECTS:

"REGISTRATION INFORMATION": You provide to ICS Mobile, INC certain personally-identifiable information such as your name, email address, date of birth, etc.) when choosing to subscribe to the ICS Mobile, INC Services.
"LOCATION INFORMATION": To provided the ICS Mobile, INC Services, we derive location information or directly from the mobile device that you used to register with ICS Mobile, INC.
"LOG FILE INFORMATION": When you use the ICS Mobile, INC Services, our servers automatically record certain information about your usage from your mobile device and web browser. These server logs may include information such as a mobile device identification number and device identifier, web requests, Internet Protocol ("IP") address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, features used in the ICS Mobile, INC mobile application, the number of messages and friend requests related to your profile, the amount of time spent on particular web pages, the dates and times of your requests, and one or more cookies that may uniquely identify your browser.

THE WAY ICS MOBILE, INC USES INFORMATION:

ICS Mobile, INC uses your personally identifiable, registration, profile, and location information to operate, maintain, and provide to you and other Users all of the features and functionality of the ICS Mobile, INC Service.
To provide the basic functionality of the ICS Mobile, INC Services - such as displaying your live location to your friends on the Friends Map or alerting your friends when you are nearby - ICS Mobile, INC maintains for its use only each User's most recent location fix.
ICS Mobile, INC uses your personally identifiable, location, and certain non-personally-identifiable information (such as anonymous log file information) to track and analyze User preferences and trends in order to improve the quality and design of the ICS Mobile, INC Services and to create new features, promotions, functionality, and services.
ICS Mobile, INC uses your email address or mobile number from time-to-time for non-marketing or administrative purposes such as sending privacy or security related notices, notifying you of major ICS Mobile, INC Services changes, or for other customer service purposes.
ICS Mobile, INC uses your personally identifiable, registration, profile, and location information to personalize and serve in-service advertisements specifically to you and your interests. For example, if you put a favorite band in your profile, then we might serve you an advertisement highlighting the concert of a similar band playing in your city. However, we do not disclose who you are to the music company.

WHEN ICS MOBILE, INC DISCLOSES INFORMATION:

ICS Mobile, INC discloses some personally identifiable, registration, profile, or location information to subsidiaries, affiliated companies, or other businesses or persons for the purpose of providing certain features of the ICS Mobile, INC Services, in order to serve relevant advertisements in support of the ICS Mobile, INC Services, and for processing such information on our behalf. For example, we may disclose information to wireless carrier partners for the purpose of revenue recognition, or we may disclose certain information in order to provide mapping, points-of-interest, local content, or navigation features. We require that these parties agree to process such information in compliance with our privacy policy, we use reasonable efforts to limit their use of such information, and we require these parties to use any other appropriate confidentiality and security measures.
ICS Mobile, INC discloses aggregate, anonymous log file and usage information in reports to interested third parties to assist those parties in understanding the usage patterns and performance results of certain advertisements, content, services, promotions, or features. For example, we may provide aggregate-level reports to an advertising partner for the purpose of showing delivery and performance statistics of a specific advertising campaign.
ICS Mobile, INC may release personally identifiable, registration, profile, or location information if required to do so by law, or in the good-faith belief that such action is necessary to comply with state and federal laws or respond to a court order, subpoena, or search warrant.
ICS Mobile, INC also reserves the right to disclose personally identifiable, registration, profile, or location information that ICS Mobile, INC believes, in good faith, is appropriate or necessary to: enforce our Terms of Use; take precautions against liability; protect Users from fraudulent, abusive, or unlawful uses; investigate and defend ourselves against any third-party claims or allegations; assist government enforcement agencies; protect the security or integrity of the ICS Mobile, INC Services; or protect the rights, property, or personal safety of ICS Mobile, INC, Users, or others.
ICS Mobile, INC does not share your personally identifiable information or personally-identifiable location information with other, third-party companies for their commercial or marketing use without your express consent or unless you have opted-in to be part of a specific program or feature in accordance with the applicable ICS Mobile, INC Services consent procedures.

ITag Call Sessions Policy:

The service is provided by Freeconferencall.com, no extra charges or fees is assessed for this service. The minute's usage is equivalent to the minute's usage from the call plan you obtained from your wireless provider. Free Conferencing Corporation recognizes the importance of protecting the privacy of all information provided by users of our products, services and websites. We created this policy out of respect for our customers' fundamental right to privacy and to help guide our relationship with our customers. This Privacy Policy discloses the privacy practices for all products and services owned by Free Conferencing Corporation. A current list of our products can be found at www.FreeConferenceCall.com.

1. GENERAL POLICY REGARDING CUSTOMER INFORMATION

a. FREE CONFERENCING CORPORATION DOES NOT SELL, RENT OR DISTRIBUTE CUSTOMERS PERSONAL INFORMATION INCLUDING NAME, EMAIL ADDRESS, PHONE NUMBER, ADDRESS OR COMPANY. We periodically issue technical and marketing information and are committed to an "opt in/opt out" permission based philosophy. If you voluntarily submit your e-mail address to receive information, we may subsequently issue information via e-mail. However, we respect the right to opt out and will remove e-mails from our list on request.

2. CUSTOMER INFORMATION COLLECTION

a. Registration Pages- Each of our products requires the customer to register with at least a name and email address. For internal purposes, we use this information to identify accounts and monitor usage. This information is also used to communicate with our customers (See Section 2: Customer Communications for full details). Our paid services including SimpleEvent, SimpleFlatRate, SimpleTollFree, SimpleVoiceBox and SimpleVoiceCenter require customer credit card information. This includes name, card number and expiration date, which is used for our or our agents' billing purposes only, and is not otherwise shared.

Telemarketing- Some customer information is obtained through telemarketing and marketing lists. Potential customer information is not registered into the Free Conferencing Corporation database unless express permission is given.
Customer Service- Additional customer information given through our customer service group is not currently appended to the customer account information.
Surveys and Contests- Customer information including phone number, address, email, title and company may be collected during a survey or contest. Since prizes may be awarded during these events, it is critical that Free Conferencing Corporation collect full customer details. This information is stored in a separate database and may be used for further marketing activities.

3. CUSTOMER COMMUNICATIONS

a. Email Contact- Free Conferencing Corporation uses email to make contact with its customers. Customers receive an initial registration email with all account details listed. After each call, customers receive call detail reports via email. Finally, Free Conferencing Corporation uses email to communicate promotions, product updates and technical advisories with their customers.

Opting Out of Contact- Opting out of contact with Free Conferencing Corporation can be done by unsubscribing from email lists. There are 3 main lists that a customer will need to unsubscribe from; call detail reports, email marketing and technical advisories. Unsubscribing from technical advisories will result in the cancellation of the customers account.

4. SECURITY

a. We use reasonable precautions to protect our customers' personal information and to store it securely. Sensitive information that is transmitted to us online (such as credit card number) is encrypted and is transmitted to us securely. In addition, access to all of our customers' information, not just the sensitive information mentioned above, is restricted. Only employees who need the information to perform a specific job (for example, a billing clerk or a customer service representative) are granted access to personally identifiable information. Finally, the servers on which we store personally identifiable information are kept in a secure environment.

5. LINKS

a. Our web sites contain links to other sites. Free Conferencing Corporation is not responsible for the privacy practices or content of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each web site to which we may link that may collect personally identifiable information.

6. CHILDREN

a. Free Conferencing Corporation products, services and websites are not directed at individuals under thirteen years of age, and Free Conferencing Corporation does not intend to collect any personally-identifiable information from such individuals.

7. CALIFORNIA PRIVACY RIGHTS

a. Beginning on January 1, 2005, California Civil Code Section 1798.83 permits those customers that are California residents to request that Free Conferencing Corporation not share your personal information with third parties for their direct marketing use. To make such a request, please write to:

ICS Mobile, INC uses commercially reasonable physical, managerial, and technical safeguards. We cannot, however, ensure or warrant the security of any information that ICS Mobile, INC receives on your behalf to operate the ICS Mobile, INC Services or that you transmit to ICS Mobile, INC and you do so at your own risk. We also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

If ICS Mobile, INC learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. ICS Mobile, INC may post a notice on the ICS Mobile, INC Services if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

OUR COMMITMENT TO CHILDREN'S PRIVACY:

Protecting the privacy of young children is especially important. For that reason, ICS Mobile, INC does not knowingly collect or maintain personally identifiable information on the ICS Mobile, INC Services from persons under 14 years-of-age, and no part of ICS Mobile, INC Services is directed to persons under 14. IF YOU ARE UNDER 14 YEARS OF AGE, THEN PLEASE DO NOT USE OR ACCESS THE ICS MOBILE, INC SERVICES AT ANY TIME OR IN ANY MANNER. If ICS Mobile, INC learns that personally-identifiable information of persons less than 14-years-of-age has been collected on the ICS Mobile, INC Services without verifiable parental consent, then ICS Mobile, INC will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child under the age of 14 has obtained a ICS Mobile, INC Services account, then you may alert ICS Mobile, INC at privacy@icsmobile.com and request that ICS Mobile, INC delete that child's personal information from our systems.

INTERNATIONAL VISITORS:

The ICS Mobile, INC Services are hosted in the United States and are intended for United States visitors. If you are using the ICS Mobile, INC Services from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal data to the United States and by providing your personal data you consent to that transfer. Additionally the iTag Call Sessions are only accessible from the United States Of America.

THIRD-PARTY ADVERTISERS AND AD-SERVING COMPANIES:

Advertisements that appear on ICS Mobile, INC are sometimes delivered (or "served") directly to Users by third-party advertisers or ad network companies. These companies may automatically receive your IP address or other information about your mobile device or personal computer when serving advertisements. These third parties may also download cookies to your computer, or use other technologies such as JavaScript and "web beacons" (also known as "1x1 gifs") to measure the effectiveness of the advertisements served and to personalize advertising content. Doing this allows the advertiser or ad network to recognize your computer or mobile device each time they send you an advertisement in order to measure the effectiveness of the ad and to personalize advertising content. These companies may compile information about the sites or services visited when seeing advertisements and determine which advertisements are clicked. ICS Mobile, INC does not access or have control of the cookies that may be placed by third-party advertisers or ad networks. Likewise, third party advertisers and ad networks do not have access to your personal information stored with ICS Mobile, INC unless you choose to share it with them. This Privacy Notice does not cover the use of tracking technologies or personal data by any such third-party advertisers or ad networks.

IN THE EVENT OF MERGER, SALE, OR BANKRUPTCY:

In the event that ICS Mobile, INC is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from our Users as part of such merger, acquisition, sale, or other change of control so that the ICS Mobile, INC Service can continue operations. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used. You will be notified via notice through the ICS Mobile, INC Services of any such change in ownership or control of your personally identifiable information.
